PASTORALE, a simplified joint stock company with capital of €100,000, registered with the Melun Trade and Companies Register under number 384 126 603 and headquartered at route de Nemours - 77760 URY / FRANCE, directly and indirectly creates and markets CANASUC brand products.
Thank you for visiting the CANASUC brand website, professional.canasuc.com, (hereinafter referred to as "the Site").
You must read the general terms and conditions of sale and use (hereinafter referred to as "the General Terms and Conditions of Sale and Use") set out below before using this Site.
Any access to or use of the Site implies compliance with and unreserved acceptance of all the General Terms and Conditions of Sale and Use. If you do not wish to accept all or part of them, you are requested to refrain from using this Site.
PASTORALE reserves the right to modify the terms, conditions and mentions of the present General Conditions of Sale and Use and legal mentions. These changes are deemed accepted without reservation when you access the site, after this online.
You acknowledge that these Terms and Conditions of Sale and Use constitute the entire and exclusive agreement between you and PASTORALE with respect to your use of the Site.
TERMS AND CONDITIONS OF SALE
The General Terms and Conditions of Sale and Use apply to all orders placed through the Site, regardless of any clauses that may appear on the buyer's documents.
Where a case is not covered by these terms and conditions, the distance selling rules of the place where PASTORALE has its registered office shall apply.
PASTORALE's offers on the Site are intended for professionals only. They are exclusively reserved for merchants and all persons exercising an independent professional activity who can prove the existence of their business and/or their professional status by producing a Kbis extract, a trade register extract less than 3 months old or any other valid document proving their professional activity.
PASTORALE reserves the right to cancel, limit or reduce the quantity of any order that may be made in violation of these Terms and Conditions of Sale and Use.
ORDERS AND OFFER VALIDITY
Ordering procedure
A detailed description of the Products is available when viewing each one individually on the Site.
This system requires an active approach on your part. It complies with the legal requirements for online sales and consumer protection.
To order the desired Products, enter the product sheet of the items you wish to purchase by clicking on their picture, choose the desired quantity, then click on "Add to cart". Your choices will be automatically added to your basket.
You can choose several Products of the same reference by changing the quantities in the order summary. You can also cancel any of the previously selected Products by entering "0" in the quantity column or by clicking on the "X" button to the left of each Product.
Once you have ordered all the products you require, click on "Proceed to checkout" in the shopping cart summary. Then fill in the form with your full delivery and billing details, or choose an address from those already registered if you have a customer account.
Finally, choose your payment method, check your order and then click on "Checkout" to finalize your order.
If you forget any of the above, your order will not be valid.
At the end of the form, don't forget to tick the box "I have read and accept the terms and conditions of sale", otherwise you won't be able to confirm your order.
Order acceptance
PASTORALE undertakes to accept orders placed by Internet, within the limits of available stocks, under the terms of the present document, of which you must declare that you are aware when you validate the order.
In accordance with Articles L.111-1 et seq. and L.121-17 of the French Consumer Code, you must be able to know the essential characteristics of the Products (nature, quantity, substantial qualities, etc.), their price, the methods of payment accepted, the delivery period and restrictions, as well as the period, terms and conditions for exercising the right of withdrawal and the cases in which this right may not be exercised.
Before concluding the sales contract, you will see on your screen an order form detailing your entire order at the price inclusive of all taxes (excluding delivery costs), which you may modify or cancel. In order to validate this order form, you must acknowledge that placing your order implies the obligation to pay for it in full, and you must also read the General Terms and Conditions of Sale and Use by ticking the appropriate box and then clicking on the "Order" button. Ticking the above-mentioned box is an essential condition for validating your order.
The fact that you fill in the order form on the Site, pay for it and confirm it by clicking on the "Order" button, implies full acceptance of the present conditions. These conditions alone shall apply to the contract thus concluded.
For any purchase on our Site, a confirmation e-mail will be sent to you mentioning the number of your order and the details of the Products ordered.
Limitations
In case of stock shortage, PASTORALE undertakes to inform you by mail to the e-mail address you have indicated, as soon as possible. PASTORALE will inform you of the lead times required to obtain the desired Product or will offer you a replacement Product of equivalent value.
PASTORALE is not able to manage backorders: if a Product is out of stock without a precise restocking period, PASTORALE will offer you a refund of the Product ordered, via the method of payment used at the time of your order.
All orders will be considered only after receipt of full payment for the Products and will be confirmed by PASTORALE by e-mail and on the customer area "my account".
PASTORALE reserves the right to cancel any orders that do not conform, are suspect or have been placed in bad faith. In addition, we reserve the right to refuse any order from a customer with whom there is any previous or current dispute.
Price
Prices shown are in Euros and exclusive of tax.
They include the price of the Products, handling, packaging and storage costs. Prices are valid on the date the order is validated. Prices are subject to change without notice. They do not include postage and delivery charges, which may vary according to the amount and weight of the order and/or the country of dispatch [Cf. link].
All orders delivered outside mainland France may be subject to local taxes and customs duties, which are the sole responsibility and expense of the buyer.
You may be asked to pay customs duties and taxes by the carrier at the time of delivery. These customs duties and taxes are your responsibility.
Under no circumstances will PASTORALE be required to bear additional costs related to the delivery of the order excluding transport charges, described and invoiced at the conclusion of your order on the Site.
The price indicated in the order confirmation is the final price including VAT.
Terms of payment
Payment for Products purchased on the Site is made in full when the order is placed. Products remain the property of PASTORALE until full payment of the order.
Payment can be made by credit card or PayPal.
Your credit card will be debited upon confirmation of your order.
To this end, you guarantee that you are the holder of the bank card to be debited and that the name on the card is your own.
Payment security
The payment security protocol used is 3D Secure, which complies with PCI DSS standards. It guarantees total confidentiality of personal information transmitted over the Internet. Your credit card details are not stored on the site, and your payment can only be viewed in encrypted form.
However, in order to facilitate the purchasing process for future orders, a system for saving your bank details is available. To do so, you must check the "Optional - Save this credit card" box on the Site's payment information page. Your bank details are stored in encrypted form only, and are only kept for as long as is strictly necessary to manage customer relations, and under no circumstances longer than 2 years from the date of your last order.
Saving your credit card details is not compulsory for ordering on the Site. In addition, you can delete your registered card details at any time by going to "My Account" - "My credit cards".
In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to all your personal data at any time..
Delivery
PASTORALE undertakes to do its utmost to deliver the Products ordered within the times indicated here. It is specified that orders placed on the site on Friday afternoon, Saturday or Sunday will not be processed until the following Monday. Furthermore, orders placed on the Site on a public holiday will only be processed on the next working day. Finally, orders placed on the Site in the afternoon will not be processed until the following day.
Finally, in the case of exceptional operations (e.g. private sale) organized by PASTORALE or by a third party, the Products may be delivered within a longer period than usual.
Delivery rates are as follows:
Metropolitan France
For all orders delivered in metropolitan France and less than 300 € of purchase, add :
- 12€ for parcels under 2 kg
- 15€ for all parcels between 4 and 6 kg
- 30 for parcels over 6 kg
- Free shipping on orders of €300 or more within mainland France.
EUROPE
For orders delivered within Europe, add :
- 14.40 for parcels under 2 kg
- 20.40 for parcels between 4 and 6 kg
- 36€ for all parcels over 6 kg
UK AND SWITZERLAND
For orders delivered to the UK or Switzerland, add :
- 18 for parcels under 2 kg
- 24 € for parcels between 4 and 6 kg
- 38 for parcels over 6 kg
The order is delivered to the delivery address you have chosen. The information stated and recorded during the order are binding. In case of error in the address of the recipient, the company PASTORALE can not be held responsible for the impossibility in which it could be to deliver the product (s) due to this error. Moreover, in this case, PASTORALE will not be able to make a second delivery. The price of the order will then be refunded, after receipt of the return package at the warehouse of PASTORALE.
Products travel at the risk of PASTORALE. The risks are transferred to the customer at the time of delivery of products to the address specified by the latter.
PASTORALE guarantees that the Products are in perfect condition when handed over to the carrier. In the event that the Products are damaged, your reservations must be made in writing to the carrier at the time of delivery, or no later than 4 hours after this delivery. A copy of these reservations must be sent to PASTORALE by e-mail to contact@canasuc.com, no later than 12 hours after these reservations have been made.
If the above procedure has been followed, and if it is thus proven that the reservations are due to the fact that the package and the Products are damaged, PASTORALE at its option will establish a credit note, refund the customer the price paid or make a new delivery of similar Products.
No non-validated return of Products will be accepted.
- Right of withdrawal
Pursuant to the provisions of Articles L.121-21 et seq. of the French Consumer Code, you have a period of 14 clear days from delivery to exercise your right of withdrawal. When the 14-day period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.
To exercise your right of withdrawal, please send us your request with details of the purchase (order number, date, method of payment) to the following address: PASTORALE - Service Client Canasuc - Route de Nemours - 77760 Ury.
Upon receipt of your request, Customer Service will contact you using the contact details provided in order to organize the return of the Products, the direct costs of which remain at your charge.

Reimbursement will be made as soon as possible after receipt of the returned Product(s) and at the latest within 14 days of receipt of the Product(s), and will be made by the same means of payment used at the time of purchase.
However, reimbursement will only be made if the Product is returned in perfect condition, in its original packaging, accompanied by any accessories, instructions and documentation. Moreover, Products that have been unsealed and/or mixed inseparably with other products will not be reimbursed.
Only you may exercise this right of withdrawal. In the event of delivery to a person other than the customer, this right cannot be exercised by the recipient of the order.
- Conformity - warranty against hidden defects:
7.1 Conformity
Products are subject to the legal warranties set out in articles L.211-4 to L.211-14 of the French Consumer Code.
Thus, in accordance with Article L.211-4 of the French Consumer Code, PASTORALE is required to deliver goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery. PASTORALE is also responsible for defects in conformity resulting from packaging, assembly instructions or installation when the latter has been charged by the contract or has been carried out under its responsibility.
Pursuant to Article L.211-5 of the French Consumer Code, in order to conform to the contract, the goods must: 1) Be fit for the use normally expected of similar goods and, where applicable: correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model; present the qualities that a buyer may legitimately expect in view of public statements made by the seller, the producer or his representative, particularly in advertising or labelling. 2) or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.
However, you are solely responsible for the choice of products and their conservation from delivery and their use. PASTORALE cannot guarantee that the order will meet your specific requirements.
7.2 Warranty against hidden defects
In application of the provisions of articles 1641 et seq. of the French Civil Code, PASTORALE is bound by the guarantee of hidden defects, i.e. "hidden defects of the thing which render it unfit for the use for which it was intended, or which so diminish this use, that the buyer would not have acquired it, or would only have given a lesser price for it, if he had known of them".
In the event of an action under the legal warranty of conformity :
In the event of non-conforming delivery, you have up to 24 months from the date of delivery of the Products to take action. In addition, you are exempted from having to prove the existence of the lack of conformity during the six (6) months following delivery of the Products.
In the event of a lack of conformity, you can choose between repair and replacement. However, the seller may not proceed according to the buyer's choice if this choice would entail a cost that is manifestly disproportionate to the other option, taking into account the value of the good or the importance of the defect. In this case, the seller is obliged to proceed according to the method not chosen by the buyer, unless this is impossible.
If the warranty against hidden defects is invoked :
In accordance with article 1644 of the French Civil Code, you have the choice of returning the item and having the price refunded, or keeping the item and having part of the price refunded, as determined by experts.
The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect, in accordance with article 1648 of the French Civil Code).
- Reservation of ownership
In accordance with the law of May 12, 1980, the Products delivered to you are sold under reservation of title. The transfer of ownership is subject to full payment of the price of the Products, on the due date agreed between the parties.
Products remain the property of PASTORALE until full payment of orders.
CONDITIONS OF USE
- Liability
PASTORALE undertakes to take all the necessary care to implement the service offered to you.
The Site provides you with information (photos, texts) for information purposes, as is, with all their imperfections, errors, omissions, inaccuracies and other ambivalences that may exist, and are in no way contractual. Furthermore, this information must be taken into consideration at the time it is put online and not at the time the Site is consulted.
PASTORALE declines all responsibility:
- For any interruption, malfunction or unavailability of access to the Site ;
- For any misuse or incorrect configuration of your computer;
- For any damage of any nature whatsoever resulting from fraudulent intrusion by a third party leading to modification of the information made available on the Site.
- For any failure due to a fortuitous event or force majeure such as, and without limitation, disasters, strikes, fires, floods, failure or breakdown of equipment, means of transport, communications or due to your actions.
- For any indirect damage such as loss of profits, loss of earnings, loss of data, loss of clientele which may result from the use of the Site, or on the contrary from the impossibility of its use.
In any case, whatever the reason for PASTORALE's liability, its responsibility is limited to the lower of the two sums: (i) the amount of direct damage suffered by the customer or (ii) the price of the order.
- Privacy and confidentiality
The creation of a customer account on our Site requires you to provide a certain amount of personal information about yourself.
The processing of this information has been declared to the CNIL under number 1885226.
PASTORALE is committed to respecting the confidentiality of information that you provide voluntarily or that is collected automatically by PASTORALE.
All information left on the site (name, address, e-mail ...) will not be used for any other purpose (rental or sale of file) that that related to the processing of the order and the management of commercial relations between you and PASTORALE.
In accordance with the French Data Protection Act of January 6, 1978, amended in 2004, you have the right to access and rectify any information concerning you. - Intellectual property
All elements (text, logos, trademarks, images, sound elements, software, icons, layout, databases, domain names) appearing on the Site are the exclusive property of PASTORALE or are subject to authorization of use. Any reproduction or representation, total or partial, on any support, of any element appearing on the Site is strictly forbidden, with the exception of a copy for private, individual, personal, non-transmissible and non-commercial use and subject to respect for intellectual property rights and any other property rights mentioned. Any transfer or license of any of the elements making up the Site is subject to the prior written authorization of PASTORALE, and any offender will be liable to prosecution.
PASTORALE declines all responsibility in the event of abusive and/or unauthorized use of these elements.
- Cookies
Cookies are used to facilitate navigation on the Site and to streamline registration and audience measurement procedures. - Claim
The Products offered are in accordance with current French legislation. PASTORALE cannot be held responsible in the event of failure to comply with the legislation of the country where the Products are delivered. It is the customer's responsibility to check with the local authorities the possibilities of importing or using the products he/she intends to order.
Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to expose such situations.

- Disputes - Applicable law
Only the French version of these General Terms and Conditions of Sale and Use is binding. In the event of translation into one or more other languages, the French text shall prevail in the event of dispute.
The rights and obligations of the parties are governed by French law, and in particular by the rules of distance selling (articles L 121-16 to L 121-20 of the French Consumer Code), the Law for Confidence in the Digital Economy of June 21, 2004 and the Law on Data Processing, Data Files and Individual Liberties of January 6, 1978.
The French courts shall have exclusive jurisdiction over all disputes, whatever their nature or cause.
- "Games and Contests" organized by PASTORALE and its partners
PASTORALE may organize games and contests on the Site. Participation requires active participation on your part, in particular by filling in a participation form or entering a participation code.
Notwithstanding the rules of the game relating to the participation in question, the Products in question are available exclusively within the limits of available stocks.
Furthermore, the Products won cannot be sold or exchanged.
- Newsletter
You can subscribe to the Canasuc newsletter in order to receive information on news and events from Canasuc and its partners, in particular by checking the box "Subscribe to the Newsletter" or from the home page by entering your email address in the dedicated field.
You can unsubscribe at any time by clicking on the unsubscribe link at the bottom of each newsletter and entering your email address, or directly on the site.
- My Wish List
19.1 Creating a "My Wish List
You can create your "My Wish List" on the Site. This list allows you to save your favorite Products in a list(s) dedicated to these Products. To do this, click on "My Wish List" in "My Account". If you have a Canasuc customer account: enter your email address and your login password; if you do not have a Canasuc customer account: create one by entering your email address then click on "OK". From this page you can create your list. Return to the Site home page and choose your favorite product(s) by clicking on the "My Wish List" icon on the photos. You can add the products on your list to your basket using the dedicated button. The Site's "Shopping Cart" page opens and the contents of your list are automatically transferred to it. If you decide to purchase your entire list, please refer to article 1 of these General Terms and Conditions of Sale and Use to follow the standard ordering process. If you remove Products from your basket, this will not affect your list.
19.2 Share your "My Wish List" on Facebook
You can share your lists on your personal Facebook page by clicking on the "Share" icon. In this case, a Facebook page will open to allow you to connect to your personal Facebook account. This new page is an Internet page independent of the Canasuc company and website, and belongs exclusively to the Facebook company. PASTORALE declines all responsibility for the content, comments, information, images, videos, without this list being exhaustive, which may appear on the Facebook pages (see article 14).
