COMPETITION RULES Facebook Competition- Canasuc Article 1: Organisation SAS PASTORALE, with a share capital of €10,000, hereinafter referred to as «the Organiser», whose registered office is situated at Route de Nemours BP20, 77760 Ury, registered under Melun Trade and Companies Register number 384126603, is organising a free competition with no obligation to purchase, running from 22 September 2021 to midnight on 5 October 2021 (including the day itself). Article 2: Participants This free competition, with no obligation to purchase, is open exclusively to individuals who are of legal age on the start date of the competition and who are resident in mainland France (including Corsica). Persons who do not meet the above conditions are excluded from the competition, as are staff members of «the Organiser», and any person who has directly or indirectly participated in the design, implementation or management of the competition, as well as their spouses and family members: direct ascendants and descendants or other relatives, whether or not they live in the same household. The Organiser reserves the right to ask any participant to provide proof that they meet the conditions set out above. Any person who does not meet these conditions or who refuses to provide proof will be excluded from the competition and, should they win, will not be entitled to their prize. Only one entry per person is permitted (same name, same address). «The Organiser» reserves the right to carry out any checks to ensure compliance with this rule. Entry into the competition implies full acceptance of these rules. Article 3: How to enter Participants must visit the following URL: • https://www.facebook.com/canasuc.paris Participants must comment on the post. Any entry made in breach of these rules will be deemed invalid. Any entrant suspected of fraud may be excluded from the competition by «the organiser» without the organiser being required to provide any justification. Any entry that is incomplete, incorrect or illegible – whether intentionally or not – or submitted in a form other than that specified in these rules shall be deemed invalid. The same penalty shall apply in the event of multiple entries. Article 4: Prize The prize on offer is: • 2 boxes of Canasuc moulded sugar «Ronde de douceurs» (€39.80 incl. VAT) Total value: €39.80 incl. VAT. The value of the prize is determined at the time of drafting these rules and shall not be subject to dispute regarding its valuation. All costs incurred following the competition, in particular for the maintenance and use of this prize, shall be borne entirely by the winner. Article 5: Selection of the winner At the end of the competition, the prize draw will take place on 6 October 2021. Article 6: Announcement of the winner The winner will be notified by private message. The winner will therefore have 15 days to provide their postal address. Page 1/3 Article 7: Delivery of the prize The prize will be sent to the postal address provided by the participant. In the event of the prize being returned undelivered, it will remain available to the participant for 15 days. After this period, they will no longer be entitled to claim it. The winner undertakes to accept the prize as offered, without the possibility of exchange – in particular for cash, other goods or services of any kind – or transfer of the prize to a third party. Similarly, this prize may not be the subject of a claim for compensation. «The Organiser» reserves the right, in the event of circumstances beyond its control – in particular those relating to its suppliers or unforeseeable circumstances – to replace the advertised prize with one of equivalent value. The winner will be kept informed of any changes. Article 8: Use of participants« personal data Participants» information is recorded and used by «the organiser» to record their entry into the competition and to enable the prize to be awarded. Participants may, on legitimate grounds, object to the processing of their personal data provided in connection with this competition. They also have the right to object to their data being used for marketing purposes outside the scope of this competition; they may exercise this right as soon as their entry is registered by writing to «the Organiser», whose address is set out in Article 1. The winner(s) authorise «the Organiser» to use their contact details (surname, first name) for advertising or public relations purposes, in any medium whatsoever, without this conferring upon them any remuneration, right or benefit whatsoever, other than the award of their prize. In accordance with the Data Protection Act in its latest version, as well as Regulation No. 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), the participant may exercise their right of access, rectification, erasure of data, restriction of processing, their right to data portability, their right to object, and their right to withdraw their consent by writing to «the Organiser», whose address is set out in Article 1. Article 9: Competition Rules The competition rules are filed with SELARL ACTA – PIERSON et ASSOCIES, a firm of judicial officers, with its registered office at 15 rue de Sarre, BP 15126, 57074 METZ Cedex 3. The rules may be viewed on the following website: • https://www.canasuc.com/?page_id=20859 They may be sent free of charge to anyone who requests them from «the Organiser». «The Organiser» reserves the right to extend, shorten, amend or cancel the competition at any time, particularly in the event of force majeure, without participants being entitled to claim any compensation. The rules, as amended by any addendum(s), will be filed, where applicable, with SELARL ACTA – PIERSON et ASSOCIES, a bailiff’s office, with its registered address at 15 rue de Sarre, BP 15126, 57074 METZ Cedex 3. Article 10: Industrial and Intellectual Property The reproduction, representation or exploitation of all or part of the elements comprising the competition, including these rules, is strictly prohibited. All trade marks, logos, texts, images, videos and other distinctive signs reproduced on the website, as well as on websites to which it provides access via hyperlinks, are the exclusive property of their respective owners and are protected as such by the provisions of the Intellectual Property Code throughout the world. Their unauthorised reproduction constitutes an infringement punishable by criminal penalties. Any unauthorised reproduction, in whole or in part, of these trade marks, logos and signs constitutes an infringement Page 2/3 punishable by criminal penalties. Participation in this competition implies full and unconditional acceptance of these rules by participants. Article 11: Liability The «organiser» shall not be held liable in the event of force majeure or unforeseeable circumstances beyond its control. The «organiser» shall not be held liable for delays, losses, theft, damage to post, or illegible postmarks attributable to the postal services. Nor shall it be held liable, and no claim may be brought against it, in the event of circumstances constituting force majeure (such as strikes, adverse weather conditions, etc.) which partially or totally deprive participants of the opportunity to take part in the competition and/or the winner of the benefit of their prize. «The Organiser», together with its service providers and partners, shall under no circumstances be held liable for any incidents that may arise in connection with the use of the prize by the winner or their guests once the winner has taken possession of it. Similarly, «the Organiser», together with its service providers and partners, shall not be held liable for the loss or theft of the prize by the winner once the winner has taken possession of it. Any additional costs incurred in taking possession of the prize shall be borne entirely by the winner, who shall not be entitled to claim any compensation from «the Organiser», its service providers or partners. This competition is not managed or sponsored by Facebook, which «the Organiser» hereby releases from all liability. Article 12: Disputes & Complaints These rules are governed by French law. «The Organiser» reserves the right to make a final and binding decision on any dispute that may arise regarding the interpretation or application of these rules, on the understanding that no disputes will be accepted – in particular regarding the terms of the competition, the results, the prizes or their receipt – one month after the end of the competition. Except in the case of obvious errors, it is agreed that the information generated by the Organiser’s competition systems shall constitute conclusive evidence in any dispute concerning connection details and the computer processing of said information relating to the competition. Any complaint must be addressed to «the Organiser» within one month of the competition’s end date. After this date, no complaints will be accepted. Participation in the competition implies full acceptance of these rules. Article 13: Agreement on Evidence By express agreement between the participant and «the Organiser», the «Organiser’s» computer systems and files shall be the sole source of evidence. The computerised records, stored in the Organiser’s computer systems under reasonable conditions of security and reliability, shall be deemed to constitute evidence of the dealings and communications between the Organiser and the participant. It is therefore agreed that, barring manifest error, «the Organiser» may rely, in particular for the purposes of proving any act, fact or omission, on the programmes, data, files, records, transactions and other items (such as monitoring reports or other statements) of an IT or electronic nature, in an IT or electronic format or on an IT or electronic medium, created, received or stored directly or indirectly by «the Organiser», in particular within its IT systems. The elements in question shall thus constitute evidence and, if produced as evidence by «the Organiser» in any litigation or other proceedings, they shall be admissible, valid and enforceable between the parties in the same manner, under the same conditions and with the same probative value as any document that would be drawn up, received or retained in writing. Any actions of any kind carried out using the username and password assigned to a participant following registration are irrefutably presumed to have been carried out under the participant’s responsibility.
