Thank you for visiting the CANASUC brand website www.canasuc.com, (hereinafter referred to as "the Site").

You must read the general terms and conditions of sale and use (hereinafter referred to as "the General Terms and Conditions of Sale and Use"), set out below before using this Site.

Any access to or use of the Site implies compliance with and unreserved acceptance of all the General Terms and Conditions of Sale and Use. If you do not wish to accept all or part of them, you are requested to renounce any use of this Site.

PASTORALE reserves the right to modify the terms, conditions and mentions of the present General Conditions of Sale and Use and legal mentions. These changes are deemed accepted without reservation when you access the site, after this online.

You acknowledge that these Terms and Conditions of Sale and Use constitute a complete and exclusive agreement between you and PASTORALE with respect to your use of the Site.

GENERAL TERMS AND CONDITIONS OF SALE

The General Terms and Conditions of Sale and Use apply to all orders placed through the Site, regardless of any clauses that may appear on the buyer's documents.

If a case is not covered by these terms and conditions, the distance selling rules of the place where PASTORALE has its headquarters apply.

The offers of PASTORALE present on the website are addressed only to individuals. PASTORALE reserves the right to refuse the benefit of its offers to any professional reseller and to cancel at any time, from the date of the order and for a period of 12 months following the expected date of delivery, any order which would be placed by a professional.

All products and samples available on the Site (hereafter referred to as the "Product(s)") are intended for personal use only. You therefore undertake not to sell or resell the Products and samples of PASTORALE that you buy or receive.

PASTORALE reserves the right to cancel, limit or reduce the quantity of any order that may be made in violation of these Terms and Conditions of Sale and Use.

  1. Orders and validity of offers

1.1 Ordering procedure

A detailed description of the Products is available when viewing each one individually on the Site.

The system thus set up requires an active approach on your part. It complies with the legal requirements for online sales and consumer protection.

To order the desired Products, enter the product sheet of the items you wish to purchase by clicking on their picture, choose the desired quantity, then click on "Add to cart". Your choices will be automatically added to your basket.

You can choose several Products of the same reference by changing the quantities in the summary of your order. You can also cancel one of the Products previously selected by entering "0" in the quantity column or by clicking on the "X" button to the left of each Product.

Once you have ordered all the Products you want, click on "Proceed to payment" in the summary of your basket. Then, fill in the form with your full delivery and billing details or choose an address from those already registered if you have a customer account.

Finally, choose your payment method, check your order and then click on "Checkout" to finalise your order.

If you forget any of the above, your order will not be valid.

At the end of the form, don't forget to tick the box "I have read and accept the general terms and conditions of sale", otherwise you will not be able to confirm your order.

1.2 Acceptance of order

PASTORALE undertakes to accept orders placed by Internet, within the limits of available stocks, under the terms of the present document which you must declare that you have read when you validate the order.

In accordance with Articles L.111-1 et seq. and L.121-17 of the French Consumer Code, you must be able to know, before the conclusion of the contract, the essential characteristics of the Products (nature, quantity, substantial qualities, etc.), their price, the accepted methods of payment, the delivery period and restrictions, as well as the period, conditions and procedures for exercising the right of withdrawal, as well as the cases in which this right is not exercised.

Before the conclusion of the sales contract, you will see on your screen an order form detailing your entire order at the price inclusive of all taxes (excluding delivery costs) which you can modify or cancel. In order to validate this order form, you must acknowledge that placing your order entails the obligation to pay for it in full and to read the General Terms and Conditions of Sale and Use by ticking the associated box and then clicking on the "Order" button. Ticking the box mentioned above is an essential condition to allow you to validate your order.

The fact that you fill in the order form on the Site, pay for it and confirm it by clicking on the "Order" button, implies full and complete acceptance of these conditions. These conditions alone shall apply to the contract thus concluded.

For any purchase on our Site, a confirmation e-mail will be sent to you mentioning the number of your order and the details of the Products ordered.

1.3 Limitations

In case of stock shortage, PASTORALE undertakes to inform you by mail at the e-mail address you have indicated, as soon as possible. PASTORALE will inform you of the supply time necessary to obtain the desired product or will propose a replacement product of equivalent value.

PASTORALE is not able to manage backorders: if a Product is out of stock without a precise restocking period, PASTORALE will offer you a refund of the ordered Product, via the method of payment used during your order.

Any order will be taken into consideration only after reception of the complete payment of the Products and will be confirmed by PASTORALE by e-mail and on the customer space "my account".

PASTORALE reserves the right to cancel all orders, non-conforming, suspect, or placed in bad faith. Moreover, we reserve the right to refuse any order from a customer with whom there is any previous or current dispute.

  1. Awards

The prices displayed are in Euros and include all taxes (VAT and all other taxes according to the rates applicable in France and in force at the time of the order).

These are net prices which include the price of the Products, handling, packaging and storage costs. Prices are valid on the date of validation of the order. They may be modified thereafter, without prior notice. They do not include postage and delivery charges which may vary according to the amount, weight of the order and/or the country of dispatch.

Any order delivered outside of metropolitan France may be subject to possible local taxes and customs duties at the buyer's expense.

You may be asked to pay customs duties and taxes by the carrier at the time of delivery. These customs duties and taxes, if any, related to the delivery of an item are your responsibility.

In no case PASTORALE will be held to support additional expenses related to the delivery of the order except transport charges, described and invoiced during the conclusion of your order on the Site.

The price indicated in the order confirmation is the final price including VAT.

  1. Terms of payment

The payment of the Products bought on the Site is made in full, at the time of the order. The products remain the property of PASTORALE until the full payment of the order.

Payments are made by credit card or PayPal.

Your credit card will be charged when your order is confirmed.

To this end, you guarantee that you are the holder of the bank card to be debited and that the name on the card is yours.

  1. Securing payments

The payment security protocol used is 3D Secure, which complies with PCI DSS standards. It guarantees total confidentiality of personal information transmitted over the Internet. Thus, your credit card information is not stored on the Site and your payment can only be viewed in encrypted form.

However, in order to facilitate the purchasing process for your next orders, a system for saving your bank details is available. To do so, you must check the "Optional - Save this credit card" box on the payment information page of the Site. Your bank details are kept in encrypted form only and are only kept for the time strictly necessary to manage customer relations and will not exceed 2 years from your last order.

Saving your credit card information is not mandatory for ordering on the Site. Furthermore, you can delete your registered card details at any time by going to "My Account" - "My Credit Cards".

In accordance with the French Data Protection Act of 6 January 1978, you have the right to access, rectify and oppose all your personal data at any time.

  1. Delivery

Deliveries are possible in France and in Europe except for Switzerland.

PASTORALE undertakes to do everything possible to deliver the ordered products within the time limits indicated here. It is specified that the orders registered on the website on Friday afternoon, Saturday or Sunday will be treated only on the following Monday. Furthermore, orders placed on the Site on a public holiday will only be processed on the following working day. Finally, orders placed on the Site in the afternoon will only be processed the following day.

Finally, in the case of exceptional operations (e.g. private sale) organised by PASTORALE or by a third party, the Products may be delivered within a longer period than usual.

The delivery rates are as follows:

Add €6.50 for all orders delivered in mainland France and under €60 of purchases.

The order is delivered to the delivery address you have chosen. The information stated and recorded during the order are binding. In case of error in the wording of the address of the recipient, the company PASTORALE can not be held responsible for the impossibility in which it could be to deliver the product (s) following this error. Moreover, in this case, PASTORALE will not be able to make a second delivery. The price of the order will then be refunded to you, after reception of the return parcel at the warehouse of PASTORALE.

The products travel at the risk of PASTORALE. The risks are transferred to the customer only at the time of the delivery of the Products to the address indicated by the latter.

PASTORALE guarantees that the Products are in perfect condition when handed over to the carrier. In the event that the products are damaged, your reservations must be made in writing to the carrier at the time of delivery, or no later than 4 hours after this delivery. A copy of these reservations must be sent to PASTORALE by e-mail to contact@canasuc.com, at the latest 12 hours after these reservations have been made.

If the above procedure has been followed, and if it is thus proven that the reservations are due to the fact that the package and the Products are damaged, PASTORALE at its choice will establish a credit note, will reimburse the customer the price paid or will make a new delivery of similar Products.

No unvalidated returns of Products will be accepted.

  1. Right of withdrawal

In application of the provisions of articles L.121-21 et seq. of the French Consumer Code, you have a period of 14 clear days from the date of delivery to exercise your right of withdrawal. When the 14-day period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

To exercise your right of withdrawal, please send us your request with the details of the purchase (order number, date, method of payment) to the following address PASTORALE - Service Client Canasuc - Route de Nemours - 77760 Ury.

Upon receipt of your request, the customer service department will contact you at the contact details provided in order to organise the return of the Products, the direct costs of which remain at your charge.

The refund will be made as soon as possible after receipt of the returned Product(s) and at the latest within 14 days of receipt and will be made via the payment method used at the time of purchase.

However, the refund will only be made if the Product is returned in perfect condition, in its original packaging, accompanied by all possible accessories, instructions and documentation. Furthermore, Products that are unsealed and/or mixed inseparably with other products will not be refunded.

Only you may exercise this right of withdrawal. In case of delivery to a person other than the customer, this right cannot be exercised by the recipient of the order.

  1. Conformity - guarantee against hidden defects:

7.1 Compliance

The Products are subject to the conditions of the legal guarantees provided for in articles L.211-4 to L.211-14 of the French Consumer Code.

Thus, in accordance with Article L.211-4 of the Consumer Code, PASTORALE is required to deliver a good that conforms to the contract and is responsible for defects in conformity existing at the time of delivery. PASTORALE is also responsible for the defects of conformity resulting from the packaging, the assembly instructions or the installation when this one has been put at its charge by the contract or has been realized under its responsibility.

Pursuant to Article L.211-5 of the French Consumer Code, in order to be in conformity with the contract, the goods must: 1) Be fit for the use usually expected of similar goods and, where applicable: correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model; have the qualities that a buyer may legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labelling. 2) or have the characteristics defined by mutual agreement between the parties or be fit for any special purpose sought by the buyer, brought to the attention of the seller and accepted by the latter.

However, you are solely responsible for the choice of the Products and their conservation after delivery and their use. In no case PASTORALE can guarantee that the order meets your specific expectations.

7.2 Warranty for hidden defects

In application of the provisions of articles 1641 and following of the civil code, PASTORALE is held to the guarantee of the hidden defects, that is to say "of the hidden defects of the thing which make it unsuitable for the use for which it is intended, or which decrease so much this use, that the purchaser would not have acquired it, or would have given only a lesser price of it, if he had known them".

In the event of an action under the legal guarantee of conformity :

In case of non-conformity, you have up to 24 months after the date of delivery of the Products to act. Furthermore, you are exempted from proving the existence of the lack of conformity during the six (6) months following the delivery of the Products.

In the event of a lack of conformity, you can choose between repairing or replacing the goods. However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is clearly disproportionate to the other option, taking into account the value of the goods or the importance of the defect. He shall then be obliged to proceed, unless this is impossible, according to the method not chosen by the buyer.

If the warranty against hidden defects is invoked :

In accordance with Article 1644 of the Civil Code, you have the choice of returning the item and having the price returned to you or keeping the item and having part of the price returned to you, as arbitrated by experts.

The action resulting from redhibitory defects must be brought by the buyer within two years of the discovery of the defect, in accordance with Article 1648 of the Civil Code.)

  1. Reservation of ownership

In accordance with the law of 12 May 1980, the Products delivered to you are sold under reservation of title. The transfer of ownership is subject to the full payment of the price of the Products, on the due date agreed between the parties.

The products remain the property of PASTORALE until the full payment of the orders.

CONDITIONS OF USE

9. Liability :

PASTORALE is committed to taking all the necessary care in the implementation of the service offered to you.

The Site provides you with information (photos, texts) for information purposes, as is, with all their imperfections, errors, omissions, inaccuracies and other ambivalences that may exist and are in no way contractual. Furthermore, this information must be taken into consideration at the time it is put online and not at the time of consultation of the Site.

PASTORALE declines all responsibility:

  • For any interruption, malfunction or unavailability of access to the Site;
  • For any misuse or misconfiguration of your computer;
  • For any damage of any nature whatsoever, resulting from fraudulent intrusion by a third party leading to a modification of the information made available on the Site.
  • For any failure due to a fortuitous event or force majeure such as, and without limitation, disasters, strikes, fire, floods, failure or breakdown of equipment, means of transport, communication or due to your actions.
  • For any indirect damage such as loss of profits, loss of earnings, loss of data, loss of clientele which may result from the use of the Site, or on the contrary from the impossibility of its use.

In any case, whatever the reason for the challenge of PASTORALE, its liability is limited to the lower of the two amounts: (i) the amount of direct damage suffered by the customer or (ii) the price of the order.

  1. Protection of personal data and confidentiality :

The creation of a customer account on our Site requires you to communicate a certain amount of personal data about yourself. The processing of this information is subject to a declaration to the CNIL under number 1885226.

PASTORALE undertakes to respect the confidentiality of the information that you provide voluntarily or those collected automatically by PASTORALE. All the information left on the site (name, address, e-mail...) will not be used in any other way (rental or sale of files) than that linked to the processing of the order and the management of commercial relations between you and PASTORALE.

In accordance with the law "Informatique et Libertés" of January 6, 1978 amended in 2004, you have the right to access and rectify information concerning you, which you can exercise by writing to PASTORALE, route de Nemours 77760 Ury or by sending an e-mail to contact@canasuc.com. Please specify your name, your physical and/or electronic contact details, as well as the reference you have as a customer of the site.

You may also, for legitimate reasons, object to the processing of your data.

  1. Intellectual property :

All the elements (texts, logos, brands, images, sound elements, software, icons, layout, database, domain names) appearing on the website are the exclusive property of PASTORALE or are the subject of an authorization of use. Any reproduction or representation, total or partial, on any medium, of any element appearing on the site is strictly prohibited, except for a copy for private, individual, personal, non-transferable and non-commercial use and subject to compliance with intellectual property rights and any other property right mentioned. Any transfer or license of one of the elements of the site is subject to the prior written authorization of PASTORALE, any offender exposing himself to legal proceedings.

PASTORALE declines all responsibility in case of abusive and/or unauthorised use of these elements.

  1. Cookies/witnesses

Cookies are used to facilitate navigation on the Site and to streamline registration or audience measurement procedures. Cookies are text files placed on your computer's hard drive by a web page server. Your computer is probably set to accept cookies. However, you can change this setting to refuse cookies and PASTORALE suggests you do so if you are concerned about the use of cookies.

When you visit the Site to search for, read or download information, PASTORALE collects and retains certain "visitor information" about you, such as the name of the domain and host computer from which you access the Internet, the Internet Protocol (IP) address of the host computer, the date and time of your visit to the Site, and the URLs from which you arrived at the Site. PASTORALE uses this last information to analyze and measure the use of the Website to help make it more useful. PASTORALE destroys this information after a period of time. If you do not want PASTORALE to collect this type of information, please do not browse the Site.

Some web pages of the Site may contain web beacons that allow to count the number of visitors on the Site and/or to provide PASTORALE with a number of indicators.

  1. Claim

The Products offered are in accordance with the French legislation in force. The responsibility of PASTORALE cannot be engaged in case of non respect of the legislation of the country where the Products are delivered. It is up to the customer to check with the local authorities the possibilities of importing or using the products he/she plans to order.

Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to expose these situations.

  1. Dispute - applicable law

Only the present General Terms and Conditions of Sale and Use in French are authentic. In the event that they are translated into one or more other languages, only the French text shall be binding in the event of a dispute.

The rights and obligations of the parties are governed by French law, and in particular by the rules of distance selling (articles L 121-16 to L 121-20 of the Consumer Code), the Law for Confidence in the Digital Economy of 21 June 2004 and the law relating to information technology, files and freedoms of 6 January 1978.

The French courts shall have exclusive jurisdiction over all disputes, whatever their nature or cause.

  1. "Games and competitions organised by PASTORALE and its partners

PASTORALE may organise games and competitions on the site. Participation requires active participation on your part, in particular by filling in a participation form or by entering a participation code.

Notwithstanding the rules of the game relating to the participation in question, the Products in question are available exclusively within the limits of available stocks.

Furthermore, the Products won cannot be sold or exchanged.

You can subscribe to the Canasuc newsletter in order to receive information on news and events from Canasuc and its partners, in particular by checking the box "Subscribe to the Newsletter" or from the home page by entering your email address in the dedicated field.

You can unsubscribe at any time by clicking on the unsubscribe link at the bottom of each newsletter and entering your email address or directly on the website.

  1. My Wish List

19.1 Creating a "My WishList

You can create your "My Wish List" on the Site. This list allows you to save your favourite Products in a list(s) dedicated to these Products. To do so, click on "My Wish List" in "My Account". If you have a Canasuc customer account: enter your email address and your connection password; if you do not have a Canasuc customer account: create it by entering your email address and then click on "OK". From this page you can create your list. Go back to the home page of the Site and choose your favourite product(s) by clicking on the "My Wish List" icon on the photos. You can add the products on your list to your basket using the dedicated button. The "Shopping Cart" page of the Site will open and the contents of your list will be automatically transferred to it. If you decide to purchase your entire list, we refer you to Article 1 of these Terms and Conditions of Sale and Use in order to follow the classic ordering process. Furthermore, if you delete Products from the basket, this will not modify your list.

19.2 Sharing your Wish List on Facebook

You can share your lists on your personal Facebook page by clicking on the "Share" icon. In this case, a Facebook page will be opened to allow you to connect to your personal Facebook account. This new page is a web page independent of the company and the Canasuc website which belongs exclusively to the Facebook company. PASTORALE declines all responsibility for the contents, comments, information, images, videos, without this list being exhaustive, which could appear on the Facebook pages (see article 14).
