Thank you for visiting the CANASUC brand website, professional.canasuc.com, (hereinafter referred to as «the Website»).

You must read the terms and conditions of sale and use (hereinafter referred to as «the Terms and Conditions of Sale and Use»), set out below before using this Site.

Any access to or use of the Site implies the unreserved compliance with and acceptance of all of the General Terms and Conditions of Sale and Use. In the event that you do not wish to accept all or part of these, you are required to refrain from any use of this Site.

PASTORALE reserves the right to modify the terms, conditions and notices of these General Terms and Conditions of Sale and Use and legal notices. These modifications are deemed to be accepted without reservation as soon as you access the Site after they have been put online.

You acknowledge that these Terms and Conditions of Sale and Use constitute a complete and exclusive agreement between you and PASTORALE regarding your use of the Site.

TERMS AND CONDITIONS OF SALE

The General Terms and Conditions of Sale and Use apply to all orders placed through the Site, regardless of any clauses that may appear on the buyer's documents.

Where a case is not covered herein, the distance selling rules of PASTORALE's registered office shall apply.

The PASTORALE offers available on the Website are intended solely for trade professionals. They are exclusively reserved for traders and any persons carrying out an independent professional activity who can prove the existence of their business and/or their professional status by producing a Kbis extract, an extract from the register of trades dated less than 3 months ago, or any other valid document proving their current professional activity.

PASTORALE reserves the right to cancel, limit or reduce the quantity of any order that may be placed in violation of these General Terms and Conditions of Sale and Use.

ORDERS AND VALIDITY OF OFFERS

Ordering procedure

A detailed description of the Products is available when viewing each of them individually on the Site.

The system set up in this way requires you to take an active role. It complies with the relevant legal requirements regarding online sales and consumer protection.

To order the products you want, go to the product page for the items you wish to buy by clicking on their photo, select the quantity you want, then click on «Add to basket». Your selections will be automatically added to your basket.

You can select multiple items with the same product code by changing the quantities in your order summary. You can also remove any of the previously selected products by entering «0» in the quantity column or by clicking the «X» button to the left of each product.

Once you have ordered all the desired Products, click on «Proceed to checkout» in your basket summary. Next, fill out the form with your complete delivery and billing details or choose an address from those already saved if you are an account holder.

Finally, choose your payment method, check your order and then click «Place Order» to complete your order.

If you omit any of the above details, your order will not be valid.

At the end of the form, please remember to tick the box marked «I have read and accept the terms and conditions of sale», otherwise you will not be able to confirm your order.

Order Confirmation

PASTORALE undertakes to accept orders placed via the Internet, within the limits of available stocks, under the terms and conditions hereof, of which you must declare that you have taken note when validating the order.

In accordance with Articles L.111-1 et seq. and L.121-17 of the Consumer Code, you must be able, prior to the conclusion of the contract, to know the essential characteristics of the Products (nature, quantity, substantial qualities, etc.), their price, the accepted payment methods, the delivery time and restrictions as well as the period, conditions and procedures for exercising the right of withdrawal and the cases where this right is excluded.

Before the sales contract is concluded, you will see an order form on your screen setting out the full details of your order at the price inclusive of all taxes (excluding delivery costs), which you may amend or cancel. In order to confirm this order form, you must, firstly, acknowledge that placing your order entails an obligation to pay for it in full and, secondly, confirm that you have read the General Terms and Conditions of Sale and Use by ticking the relevant box, then click on the «Place Order» button. Ticking the box mentioned above is an essential requirement for you to be able to confirm your order.

By completing the order form on the Website, paying for it and confirming it by clicking on the «Place Order» button, you are deemed to have fully and unreservedly accepted these terms and conditions. These terms and conditions shall be the sole terms applicable to the contract thus concluded.

For any purchase made on our Website, you will receive a confirmation email stating your order number and the details of the Products ordered.

Limitations

In the event of a stockout, PASTORALE undertakes to inform you by email at the email address you have provided, as quickly as possible. PASTORALE will inform you of the delivery times required to obtain the desired Product or will offer you a replacement Product of equivalent value.

PASTORALE is unable to manage back-orders: if a Product is out of stock with no specific restock date, PASTORALE will offer you a refund for the Product ordered, via the payment method used when you placed your order.

Orders will only be processed once full payment for the Products has been received and will be confirmed by PASTORALE by email and via the «My Account» section of the customer portal.

PASTORALE reserves the right to cancel any orders that do not comply with our terms and conditions, appear suspicious, or are placed in bad faith. Furthermore, we reserve the right to refuse any order from a customer with whom we have had, or are currently having, any dispute.

Price

The prices shown are in euros and exclude tax.

They include the price of the Products, as well as handling, packaging and storage costs. Prices are valid on the date the order is confirmed. They may be subject to change at a later date without prior notice. They do not include the contribution towards postage and delivery costs, which may vary depending on the value and weight of the order and/or the country of dispatch [See link]

Any order delivered outside metropolitan France may be subject to potential local taxes and customs duties at the sole expense and charge of the buyer.

The carrier may ask you to pay any customs duties at the time of delivery. Any such customs duties and taxes relating to the delivery of an item are payable by you and are your responsibility.

Under no circumstances shall PASTORALE be required to bear any additional costs relating to the fulfilment of the order, other than delivery charges, which are described and invoiced when you complete your order on the Website.

The price shown in the order confirmation is the final price inclusive of all taxes.

Terms of payment

Payment for Products purchased on the Website must be made in full at the time of ordering. The Products remain the property of PASTORALE until the order has been paid for in full.

Payments are made by credit card or via PayPal.

Your credit or debit card will be charged when your order is confirmed.

To this end, you warrant that you are the holder of the bank card to be debited and that the name appearing on it is indeed yours.

Payment security

The payment security protocol used is 3D Secure, which complies with PCI DSS standards. It guarantees complete confidentiality of personal information transmitted over the internet. Consequently, your bank card details are not stored on the Site and your payment can only be viewed in encrypted form.

However, to make the purchasing process easier for you during your next orders, a system for saving your bank details is available. To do this, you must tick the box «Optional – Save this bank card» found on the payment information page of the Site. Your bank details are kept in encrypted form only and are only kept for the period strictly necessary for the management of the customer relationship and will under no circumstances exceed 2 years from your last order.

Saving your bank details is not compulsory in order to place an order on the Website. Furthermore, you can delete your saved card details at any time by going to «My Account» – «My credit cards».

In accordance with the Data Protection Act of 6 January 1978, you have the right to access, rectify and object to all your personal data at any time..

Delivery

PASTORALE undertakes to do its utmost to deliver the Products ordered within the timeframes indicated here. It is specified that orders placed on the Website on Friday afternoon, Saturday or Sunday will only be processed the following Monday. Furthermore, orders placed on the Website on a public holiday will also only be processed the next working day. Finally, orders placed on the website in the afternoon will only be processed the following day.

Finally, in the event of exceptional operations (e.g. private sales) organised by PASTORALE or by a third party, the Products may be delivered within a timeframe exceeding the usual timeframe.

The delivery charges are as follows:

Metropolitan France
For any order delivered to mainland France and totalling less than €300, add:

  • €12 for any parcel weighing less than 2 kg
  • €15 for any parcel between 4 and 6 kg
  • £30 for any parcel over 6 kg
  • Free delivery on orders of €300 or more within metropolitan France.

 

Europe

For any order delivered to the Europe zone, add:

  • £14.40 for any parcel under 2 kg
  • €20.40 for any parcel between 4 and 6 kg
  • €36 for any parcel over 6 kg

 

UK and Switzerland

For any order delivered to the UK or Switzerland, add:

  • €18 for any parcel under 2 kg
  • €24 for any parcel weighing between 4 and 6 kg
  • €38 for any parcel over 6 kg

     

The order is delivered to the delivery address you have chosen. The information stated and recorded when placing the order is binding upon you. In the event of an error in the wording of the recipient's contact details, PASTORALE cannot be held responsible for any inability to deliver the product(s) as a result of this error. Furthermore, in such cases, PASTORALE will not be able to make a second delivery. The order price will then be refunded to you, after receipt of the returned parcel at the PASTORALE warehouse.

The Products travel at PASTORALE's own risk. The risks are only transferred to the customer upon delivery of the Products to the address specified by the latter.

PASTORALE guarantees that the Products are in perfect condition when handed over to the carrier. In the event that the Products are damaged, your reservations must be made in writing to the carrier upon delivery, or at the latest 4 hours after such delivery. A copy of these reservations must be sent to PASTORALE by email to the address contact@canasuc.com, at the latest 12 hours after these reservations have been made.

If the above procedure has been followed, and it is thereby established that the complaints are due to the parcel and the Products being damaged, PASTORALE will, at its discretion, issue a credit note, refund the price paid to the customer or make a new delivery of similar Products.

No unvalidated Product returns will be accepted.

  1. Right of withdrawal

In accordance with the provisions of Articles L.121-21 et seq. of the Consumer Code, you have a period of 14 clear days from delivery to exercise your right of withdrawal. Where the 14-day period expires on a Saturday, Sunday or public or non-working holiday, it shall be extended until the first following working day.

To exercise your right of withdrawal, please send us your request, including the details of your purchase (order number, date, payment method), to the following address: PASTORALE – Customer Services Canasuc – Route de Nemours – 77760 Ury.

Upon receipt of your request, customer services will contact you using the details provided to arrange the return of the Products, the direct costs of which shall remain your responsibility.

The refund will be issued as soon as possible following receipt of the returned Product(s) and no later than 14 days after receipt, and will be made via the payment method used at the time of purchase.

However, a refund can only be issued if the Product is returned in perfect condition, in its original packaging, accompanied by any accessories, user manual and documentation. In addition, Products that have been unsealed and/or mixed inextricably with other products will not be refunded.

You alone will be able to exercise this right of cancellation. In the event of delivery to someone other than the customer, this right therefore cannot be exercised by the recipient of the order.

  1. Compliance – hidden defects guarantee:

7.1 Compliance

The Products are subject to the conditions of the statutory guarantees provided for in Articles L.211-4 to L.211-14 of the Consumer Code.

Therefore, in accordance with Article L.211-4 of the French Consumer Code, PASTORALE is required to deliver goods that comply with the contract and shall be liable for any lack of conformity existing at the time of delivery. PASTORALE shall also be liable for any lack of conformity resulting from the packaging, assembly instructions or installation where the latter was made its responsibility under the contract or was carried out under its responsibility.

Pursuant to Article L.211-5 of the Consumer Code, in order to conform to the contract, the goods must: 1) Be suitable for the purpose usually expected of a similar good and, where applicable: correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model; exhibit the qualities that a buyer might legitimately expect given the public statements made by the seller, the producer or their representative, notably in advertising or labelling. 2) or exhibit the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.

However, you are solely responsible for the choice of the Products, their storage from the time of delivery, and their use. Under no circumstances shall PASTORALE guarantee that the order will meet your specific expectations.

7.2 Guarantee against hidden defects

Pursuant to the provisions of Articles 1641 et seq. of the Civil Code, PASTORALE is bound by the warranty against hidden defects, namely «hidden defects in the item sold which render it unfit for the use for which it was intended, or which so impair this use that the buyer would not have acquired it, or would only have paid a lower price for it, had they known of them».

In the event of a legal conformity guarantee claim:

In the event of non-compliant delivery, you have up to 24 months from the date of delivery of the Products to take action. Furthermore, you are exempt from having to prove the existence of the lack of conformity during the six (6) months following the delivery of the Products.

In the event of a lack of conformity, you may choose between the repair and replacement of the goods. However, the seller may not proceed in accordance with the buyer's choice if this choice entails a cost that is manifestly disproportionate compared to the other option, taking into account the value of the goods or the significance of the defect. The seller is then required to proceed, unless impossible, in accordance with the option not chosen by the buyer.

In the event of the implementation of the guarantee against latent defects:

In accordance with Article 1644 of the Civil Code, you have the choice of returning the item and having the price refunded, or keeping the item and having a part of the price refunded, as determined by experts.

The action resulting from latent defects must be brought by the buyer within two years of the discovery of the defect, in accordance with Article 1648 of the Civil Code.

  1. Reservation of title

In accordance with the law of 12 May 1980, the Products delivered to you are sold subject to retention of title. The transfer of ownership is conditional upon payment in full for the Products by the due date agreed between the parties.

Therefore, the Products shall remain the property of PASTORALE until full payment of the orders has been received.

TERMS OF USE

  1. Responsibility

PASTORALE is committed to providing all necessary care in the implementation of the service offered to you.

The Site provides you with information (photos, texts) for guidance only, on an as-is basis, with all their imperfections, errors, omissions, inaccuracies and other ambivalences that may exist, and are in no way contractual. Furthermore, this information must be considered at the time it is put online and not at the time the Site is consulted.

PASTORALE disclaims all liability:

– For any interruption, malfunction or unavailability of access to the Site; ;

– For any misuse or misconfiguration of your computer; ;

- For any damage of any kind whatsoever, resulting from fraudulent intrusion by a third party which has led to a modification of the information made available on the Site.

– For any breach due to a fortuitous event or force majeure such as, and without limitation, disasters, strikes, fires, floods, failure or breakdown of equipment, means of transport, communication, or due to your actions.

– For any indirect damage such as, in particular, loss of profits, loss of earnings, loss of data, loss of clientele which may result, inter alia, from the use of the Site, or conversely from the impossibility of its use.

In any event, whatever the reason for PASTORALE being held liable, its liability is limited to the lower of the following two sums: (i) the amount of direct loss suffered by the client or (ii) the price of the order.

  1. Personal data protection and privacy

Creating a customer account on our Website requires you to provide a certain amount of personal data concerning you.

The processing of this information has been declared to the CNIL under number 1885226

PASTORALE undertakes to respect the confidentiality of the information you provide voluntarily or that collected automatically by PASTORALE.

All information left on the Site (name, address, email, etc.) will not be used for any other purpose (file rental or sale) than that related to order processing and the management of commercial relations between you and PASTORALE.

In accordance with the French Data Protection Act («Informatique et Libertés») of 6 January 1978, as amended in 2004, you have the right to access and rectify information concerning you, which you can exercise by writing to PASTORALE, route de Nemours 77760 Ury, or by sending an email to contact@canasuc.com. Please state your name, your physical and/or email contact details, and, where applicable, the reference number you hold as a customer of the Site.

You may also, on legitimate grounds, object to the processing of your data.

  1. Intellectual property

All elements (texts, logos, brands, images, sound elements, software, icons, layout, database, domain names) appearing on the Site are the exclusive property of PASTORALE or are subject to an authorisation for use. Any reproduction or representation, total or partial, on any medium, of any element appearing on the Site is strictly prohibited, with the exception of a copy for private, individual, personal, non-transferable and non-commercial use, and subject to compliance with the intellectual property rights and any other property rights mentioned. Any assignment or licence of one of the constituent elements of the Site is subject to the prior written authorisation of PASTORALE, and any infringer shall be liable to legal proceedings.

PASTORALE declines all responsibility in the event of misuse and/or unauthorised use of these items.

  1. Cookies

Cookies are used to facilitate navigation on the Site and to streamline registration or audience measurement procedures. Cookies are text files placed on your computer's hard drive by a web page server. Your computer is probably configured to accept cookies. However, you can modify this setting to refuse them, and PASTORALE suggests that you do so if the use of cookies concerns you.

When you visit the Site, to search for, read or download information, PASTORALE collects and retains certain «visitor information» about you, such as the domain name and host computer from which you access the Internet, its Internet Protocol (IP) address, the date and time of browsing on the Site and the URLs from which you came to arrive at the Site. PASTORALE uses this latter information to analyse and measure traffic to the Site in order to help make it more useful. PASTORALE destroys this information after a certain time.   1. Complaint

The Products offered comply with current French legislation. PASTORALE cannot be held liable in the event of non-compliance with the legislation of the country where the Products are delivered. It is the customer's responsibility to check with the local authorities regarding the possibilities of importing or using the products they intend to order.

Claims or disputes will always be received with attentive goodwill, as good faith is always presumed in those who take the trouble to explain such situations.

  1. Dispute – governing law

Only these French Terms and Conditions of Sale and Use shall be deemed authentic. In the event that they are translated into one or more other languages, only the French text shall prevail in the event of a dispute.

The rights and obligations of the parties shall be governed by French law, and in particular by the rules governing distance selling (Articles L 121-16 to L 121-20 of the Consumer Code), the Act on Confidence in the Digital Economy of 21 June 2004 and the Data Protection Act of 6 January 1978.

For all disputes and claims, whatever their nature or cause, the French courts shall have sole jurisdiction.

  1. «Games and Competitions» organised by PASTORALE and its partners

PASTORALE may be required to organise games and competitions on the Site. Participation entails active involvement on your part, notably by means of a completed entry form or by entering a competition code.

Notwithstanding the game rules relating to the participation in question, the Products put into play are available exclusively within the limit of available stocks.

Furthermore, the earned Products cannot be sold or exchanged.

You can subscribe to the Canasuc newsletter to receive updates on news and events from Canasuc and its partners, for example by ticking the box «Subscribe to the Newsletter» or via the homepage by entering your email address in the designated field.

You can opt out at any time by clicking the unsubscribe link at the bottom of each newsletter, by entering your email address, or directly on the website.

  1. My wishlist«

19.1 Creating your «Wishlist»

You can create your «Wishlist» on the Website. This list allows you to save your favourite Products in one or more lists dedicated to those Products. To do this, click on «Wishlist» under «My Account». If you have a Canasuc customer account: enter your email address and password; if you do not have a Canasuc customer account: create one by entering your email address, then click on «OK». You can create your list from this page. Return to the Website’s home page and select your favourite Product(s) by clicking on the «My Wishlist» icon shown on the product images. You can add the products from your list to your basket using the dedicated button. The Site’s «Basket» page will open and the contents of your wishlist will then be automatically transferred to it. If you decide to purchase your entire wishlist, please refer to Article 1 of these General Terms and Conditions of Sale and Use to follow the standard ordering process. Furthermore, if you remove products from your basket, this will not affect your wishlist.

19.2 Sharing your wishlist on Facebook

You can share your lists on your personal Facebook page by clicking on the «Share» icon. When you do this, a Facebook page will open, allowing you to log in to your personal Facebook account. This new page is a website independent of the company and the Canasuc website, and is owned exclusively by Facebook. PASTORALE accepts no liability for any content, comments, information, images or videos – though this list is not exhaustive – that may appear on Facebook pages (see Article 14).
